What is the difference between marriage in and out of community of property?
In community of property, spouses share one joint estate — including debts. Out of community (by antenuptial contract), each spouse keeps a separate estate, with or without the accrual system. The contract must be signed before the marriage, which is why timely advice matters.
How long does a divorce take in South Africa?
An unopposed divorce can be finalised in a few months. An opposed divorce involving disputes over children, maintenance or the division of the estate can take considerably longer. Mediation frequently shortens the process and reduces costs.
How do I apply for a protection order?
You apply at the Magistrate's Court, which can grant an interim order immediately if there is evidence of domestic violence. We assist with both moving and opposing protection order applications.
