Should I litigate or settle my dispute?

It depends on the strength of your case, the amounts involved, and the cost and time of proceedings. We evaluate each dispute with the client and advise on the most cost-effective route — which is sometimes negotiation or mediation rather than trial.

What is the difference between the High Court and the Magistrate's Court?

The Magistrate's Court hears claims up to R400,000 (Regional Division), while the High Court hears larger and more complex matters. Court choice affects costs, timelines and procedure, and we advise on the appropriate forum for each matter.

How long does commercial litigation take in South Africa?

A defended action can take between one and three years depending on the court's roll and the complexity of the matter. Urgent applications, interdicts, and settlement negotiations can resolve matters much faster, and we always consider these routes first.

Do you handle arbitration and mediation?

Yes. We have experience in mediation and arbitration and frequently recommend them where they will resolve the dispute faster and at lower cost than court proceedings.
