The full collection process, handled

We assist throughout the collection process:

  • Letters of demand — drafted and dispatched to trigger payment or negotiation;
  • Section 129 notices under the National Credit Act, correctly drafted so proceedings are not later invalidated;
  • Summons — drafting and issuing in the appropriate court;
  • Litigation in the various forums and divisions of the courts, through to judgment;
  • Execution — enforcement of judgments against defaulting debtors.

Built for business cash flow

Unpaid debtors are a working-capital problem, not just a legal one. Our focus is speed and proportionality: escalating only as far as needed to secure payment, and advising honestly where a debt is not economically recoverable.

FAQ

Frequently asked questions

What is the debt collection process in South Africa?

It typically begins with a letter of demand, followed where applicable by a notice under Section 129 of the National Credit Act. If the debtor still fails to pay, summons is issued and the matter proceeds to judgment and execution — attachment of assets, garnishee orders or other enforcement steps.

What is a Section 129 notice?

Section 129 of the National Credit Act requires a credit provider to send the consumer a formal notice before commencing legal action on a credit agreement, giving them the opportunity to resolve the default. Skipping this step can invalidate the subsequent proceedings, which is why correctly drafted notices matter.

How long before a debt prescribes in South Africa?

Most contractual debts prescribe after three years from the date the debt became due, unless prescription is interrupted by acknowledgment of debt or service of summons. Acting promptly protects your claim.

What does debt collection cost?

Costs depend on the debt size and how far proceedings must go. Recoverable legal costs can often be added to the debtor's account. We structure collections to remain cost-effective relative to the amounts recovered.
